REVIEW OF THE INTER-GOVERNMENTAL AGREEMENT ON RAIL OPERATIONAL UNIFORMITY |

The Inter-Governmental Agreement (IGA) for Rail Operational Uniformity and the Australian Rail Operations Unit was required to be reviewed by mid 2002. The review was undertaken by the Allen Consulting Group under the guidance of a Steering Committee of the Standing Committee on Transport Rail Group, which reports to the Australian Transport Council (ATC) . The Review was progressed to allow it to be considered by ATC at the same time as the Review of the National Road Transport Commission Act 1991 (NRTCA Review). The ATC agreed to all recommendations of the Review Report in August 2002. The key recommendations of the Review Report agreed by ATC include: - supporting the national rail regulatory reform priorities proposed in the report of the "Review of the National Road Transport Commission Act 1991". In particular:
- the establishment of a framework to improve and strengthen the co-regulatory system including the application of mutual recognition; and
- the development of national policy on key safety issues such as fatigue, testing for drugs and alcohol and medical fitness of safety-critical rail workers;
- supporting industry initiatives aimed at broadening and deepening of the Code of Practice for the Defined Interstate Rail Network (DIRN) so that it can be extended to the intra-state network, where it interfaces with the DIRN, and diminish the need for 'local rules';
- supporting a change of ownership of the Code from the Commonwealth to industry, making industry responsible for further development and extension of the Code; and
- establishing a consultative forum between the owner of the Code, National Transport Commission and Chief Executives of Government Transport agencies.
